Abstract

This independent study module provides knowledge and the latest information regarding current and evolving trends in resolving conflicts, other than litigation, called alternative dispute resolution (ADR) techniques. Although the focus of this offering is the clinical arena, these processes can also be applied to conflict situations that may arise in employment matters, in health care contracting and even in the development of public policy. Negotiation is the most important element common to all ADR techniques. This independent study module is designed for the staff nurse and nurse manager.

Objectives: At the conclusion of this offering, the reader will be able to

1. Explain three (3) significant American social trends which have led to the development and use of ADR techniques.

2. Describe the ADR techniques of negotiation, facilitation, mediation and arbitration.

3. Discuss three (3) benefits of using ADR techniques

4. Compare three (3) situations when ADR techniques are preferable to litigation.

5. Explore four (4) basic principles of negotiation.

6. Apply negotiation principles to case studies.
